plan for peace

At NTX Law, we believe that estate planning isn’t just for the wealthy or elderly—it’s for every Texan who wants to make life easier for the people they love most. Whether you live in Plano, Denton, Dallas, or Fort Worth, having a well-crafted estate plan ensures your wishes are followed, your family is protected, and unnecessary conflict is avoided.

Let’s break down what estate planning really means, why it matters, and how we can help.

📝 What’s Included in Estate Planning?

A comprehensive estate plan includes three major components:

last will

1. Last Will and Testament or Living Trust

Your will states how your assets will be distributed and who will care for any minor children. A living trust offers a more flexible, often more private way to manage your estate and avoid probate.

Example: Without a will, if you pass away in Texas, your estate is divided according to state intestacy laws—not your personal wishes. This can lead to major family disputes, especially in blended families or when there are estranged relatives.

With a will: Your family knows exactly what you want, and you appoint a trusted executor to carry it out.

POA

2. Power of Attorney (POA)

A POA allows someone you trust to make financial or legal decisions if you’re incapacitated. There are different types, including:

  • Durable Power of Attorney – for financial/legal decisions

  • Medical Power of Attorney – for healthcare-related decisions

Example: Imagine you’re hospitalized after a car accident. Without a POA, your spouse or adult child may struggle to pay your bills, manage your business, or access your accounts—causing delays and stress.

With a POA: A trusted agent steps in immediately to handle your affairs with clarity and authority.

AMD

This document states your wishes about life-sustaining treatment if you’re terminally ill or permanently unconscious.

Example: Without this directive, your family may face the emotional burden of guessing whether you would want to be kept on life support. This can cause guilt, disagreement, or even legal battles between loved ones.

With an advance directive: Your medical team and family have clear guidance on your end-of-life wishes.

⚠️ What Happens When You Don’t Plan?

Here are just a few consequences of dying or becoming incapacitated without an estate plan:

  • Probate Delays: Assets can be tied up for months or years in probate court.

  • Family Feuds: Disagreements over “who gets what” can tear families apart.

  • Court-Appointed Guardians: A judge, not you, decides who cares for your children or makes medical decisions.

  • Financial Confusion: Bills go unpaid, businesses stall, and accounts get frozen.

These issues are common—but entirely avoidable.
